What Is the Colorado AI Act?

Key Obligations for Deployers
Deployers — the businesses that actually use high-risk AI systems — carry the heavier compliance burden under the Act:
- Impact Assessments: Conduct a written algorithmic impact assessment before deploying any high-risk AI system. The assessment must evaluate reasonably foreseeable risks of algorithmic discrimination and document risk mitigation measures.
- Consumer Disclosure: Notify Colorado residents when a consequential decision was made using a high-risk AI system. Disclosure must be clear, timely, and in plain language.

The EU AI Act carries far steeper financial penalties, but Colorado’s $20,000-per-violation structure can compound rapidly. A deployer making 10,000 AI-assisted credit decisions a month without proper disclosure could face exposure in the hundreds of millions of dollars on paper — before any litigation multiplier.
Is It Still Happening? The Rewrite Debate
Colorado’s legislature has been debating a narrower replacement framework since early 2025. Critics of SB 205 — including a broad coalition of tech companies, chambers of commerce, and even Governor Polis himself, who signed the bill but simultaneously urged revision — argue the law is too broad, too compliance-heavy for smaller companies, and potentially out of step with emerging federal approaches.

8-Step Compliance Checklist
- Inventory your AI systems. Identify every AI tool your organization uses or sells that touches decisions in the seven high-risk sectors. Include third-party vendor tools.
- Classify each system. Determine which systems meet the “substantial factor in a consequential decision” threshold for Colorado residents. Engage legal counsel for borderline cases.
- Conduct algorithmic impact assessments. For each high-risk system, document reasonably foreseeable risks, bias evaluation results, and mitigation measures. Template these — you’ll repeat the process annually.

Colorado’s AI Act is not operating in a vacuum. On December 11, 2025, President Trump signed Executive Order 14365, directing federal agencies to identify and challenge state and local AI laws that conflict with or impede federal AI policy. The order signals an aggressive federal posture toward state-level AI regulation — though it stopped short of explicit preemption language.
Multiple states have since passed or proposed their own AI laws (Texas, Illinois, Virginia, and Utah among them), and a patchwork of 50 different state regimes is already becoming a compliance nightmare for multistate operators. Federal AI legislation has been introduced in Congress but has not advanced past committee as of April 2026.
The legal uncertainty cuts both ways. Federal preemption could invalidate Colorado’s law — but there is no preemption statute yet, and constitutional challenges take years to resolve. The smartest compliance posture right now: use NIST’s AI Risk Management Framework (AI RMF 1.0) and ISO 42001 (the certifiable AI management system standard published in 2023) as your structural backbone. Both frameworks are jurisdiction-agnostic and designed to satisfy the documentation, governance, and impact-assessment requirements that Colorado, the EU, and emerging federal frameworks all converge on. Companies that implement AI RMF and ISO 42001 now will find Colorado compliance is largely a mapping exercise — not a ground-up rebuild.
Don’t wait for certainty. In AI regulation, certainty arrives after the enforcement action.
